Notification of Summary of Decisions requested on PC 91 Hazardous Substances

Whangarei District Council gives notice that it has prepared a summary of all decisions requested by people making submissions on the following proposed plan change:   

Plan Change PC91 – Hazardous Substances

Plan Change 91 (PC91) - Hazardous Substances proposes to amend the operative Hazardous Substances chapter to give effect to the 2017 amendments to the Resource Management Act 1991, which removed the explicit function for local authorities to control the adverse effects of the storage, use, disposal, and transportation of hazardous substances.

Further submissions closed at 4:00pm on Monday 14 November 2022.

Public inspection

The summary of decisions requested may be inspected from 12 October 2022 onwards on this website and at:

  • Whangarei District Council Service Centre, Forum North, Rust Avenue, Whangārei
  • Ruakākā Service Centre, Takutai Place, Ruakākā
  • Whangārei Central Library, Rust Avenue, Whangārei.

Further submissions

Any person representing a relevant aspect of the public interest; any person who has an interest in the proposed plan change greater than the interest that the general public has; and Whangarei District Council itself may make further submissions.

A further submission must be limited to a matter in support or in opposition to an original submission.

The person making a further submission must within five (5) working days of making the further submission to Council, serve a copy of the further submission on the person who made the original submission to which the further submission relates.

Further submissions can be made in writing or electronically.

Further submissions must be in Form 6, or a similar format that complies with Resource Management Act Regulations 2003.

Public participation process

The process for public participation in the consideration of the proposal under the Act is as follows:

  • After the closing date for submissions, Whangarei District Council must prepare a summary of the submissions and this summary must be publicly notified
  • There must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made
  • If a person making a submission asks to be heard in support of his or her submission, a hearing must be held
  • Whangarei District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions)
  • Any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court. 

This notice is given pursuant to Clause 7 of the First Schedule of the Resource Management Act 1991.
