Council has proposed plan changes 82 A and B, 88 A-J, 109 115, 136, 143, 144, 145, 147 and 148 to the District Plan and is part of the rolling review of the plan.
This package includes proposals to:
- create new zones in Whangārei's urban area
- three new Open Space Zones
- new rules around transport, drinking water, stormwater and wastewater, earthworks, signs and lighting.
The proposed plan changes is broken down into three major sections:
Proposed Urban Plan Changes
Rezoning is proposed throughout the Urban Area, this includes new Living and Business Zones as well as special purpose zones and precincts.
Proposed District Wide Plan Changes
This package includes proposals for chapters containing provisions that apply to the district as a whole. Subdivision, strategic direction, transport, earthworks, signs, lighting and a three waters management chapters are included.
Proposed Plan Change 115 - Green Space Zones
This plan change proposes new zones with associated objectives, policies and provisions:
- PC115 Conservation Zone
- Open Space Zone and
- Sport and Active Recreation Zone.
Note: No resolution has been included to identify rules with either early or delayed legal effect. In the majority of cases this will mean that rules do not have legal effect prior to a Decision in terms of Clause 10(4) of Schedule One to the Resource Management Act 1991.
However, legal effect of all proposed provisions should be evaluated under the provisions of the Resource Management Act 1991.
Operative in Part on 15 September 2022
This plan change will become operative in part on 15 September 2022.
The Transport chapter is subject to two appeals (ENV-2020-AKL-000131 and ENV-2020-AKL-000132) which seek to introduce a new objective, policy and rule with respect to noise sensitive activities within 100m of a state highway or rail network boundary (or alternative or consequential relief).
Until these appeals are resolved the Transport chapter cannot be made fully operative.
Any future provisions introduced by resolution of these appeals are the part of the Transport chapter that is not operative. All other provisions in the Transport chapter will become operative.

To become a party to proceedings you must prepare a ‘section 274 notice’ in accordance with Form 33 of the Resource Management (Forms, Fees, and Procedure) Regulations 2003.
