Apply for a Code Compliance Certificate

A Code Compliance Certificate is formal confirmation that all building works have been completed in accordance with the consented documents.

The issue of a Code Compliance Certificate marks the end of the building consent process and the start of the maintenance program to keep your new building or structure performing as intended.

At the end of your building project, a Code Compliance Certificate is issued if we are satisfied on reasonable grounds that the building work complies with the Building Consent.

As soon as practicable, following completion of the building work, an owner must make application for a Code Compliance Certificate.

We make a decision whether to issue a Code Compliance Certificate 24 months from when your consent was granted even if you have not applied for either a Code Compliance Certificate and / or an extension of time.

  • If your building consent was issued on or after 1 September 2021 and you have been using the building consents portal, you can apply online.
  • If your building consent was issued before 1 September 2021 or you have not used the building consents portal, you can apply by email or in person.

Online

Step 1.Log in to our online building portal

You must have an account in our online building portal. which is called 'Objective Build'.

Once you have logged in, you can submit online applications, upload documents or track the status of your application.

Step 2.Complete the application form

Complete the Code Compliance application in Objective Build and upload any outstanding documents not already submitted to Council.

These can include:

  • memoranda from licensed building practitioner(s) stating what building work they carried out or supervised
  • any certificates relating to utilities work (e.g. gas and electrical certificates)
  • evidence that specified systems comply with performance standards set out in the building consent
  • producer statements.

If you are not ready to submit, you can save your application and complete it at a later stage.

Step 3.Assessing your application

The Building Officer undertaking the final inspection will talk you through the process and give you advice on what you need to do.

We may refuse to issue a Code Compliance Certificate for any of the following reasons:

  • the work is not complete
  • we do not have adequate evidence that the work complies with your building consent
  • if utilities work certificate(s) are not supplied
  • Producer Statements as identified on the Building Consent or through construction have not been provided
  • Development Contributions or other fees are outstanding.

Once we have a complete application, the Council has 20-working days to make a decision.  If more information is required, the clock will be stopped until the information is supplied in full.

We will check that all information is present and supporting documents have been received. They will also confirm that the completed works comply with the issued consent.

Step 4.Pay Invoice and outstanding fees

Any outstanding fees are calculated and an invoice raised.

Building control fees

If Development Contributions are applicable, they are calculated and invoiced at this point. 

Development Contributions

The Code Compliance Certificate will not be issued until all costs relating to development contributions have been paid. 

Please give clear instructions about where we should send the Code Compliance Certificate document and any invoices for outstanding fees.

You can pay the invoice either online, in person or call us with your details.  We accept Visa and Mastercard payments via our Contact Centre.

The Code Compliance Certificate is issued.

If this is a new building or a building where a compliance schedule has not been required before, a Compliance Schedule Statement will be issued to start the Building Warrant of Fitness process.

This statement will list the specified systems within the building and is the starting point for the required inspection and maintenance routines to commence as detailed in the compliance schedule.

Open to public before Code Compliance Certificate issued

If you want to have the building open to the public before the issue of the Code Compliance Certificate, a Certificate of Public Use will need to be applied for and issued before opening.

These may be used for a limited time and may also have conditions applied to ensure the safety of users of the building. Specified systems will usually be required to be operational under required inspection and maintenance routines.

Bring in the supporting documents to one of our service centres. We will check that the information is sufficient for the application and, if not, will advise what is missing.

If an application for a Code Compliance Certificate has not been made within 24 months from the date the building consent was granted, the Council must decide whether to issue the Code Compliance Certificate.

If the building work is still in progress, extending this time frame can be arranged. We will contact you to advise you of your options.

If you do not apply for Code Compliance Certificate or agree to an extension of time, we will make a decision to either issue or the refuse the issue of the Code Compliance Certificate.

Following a full technical review, to ensure that all aspects of the building consent have been satisfied, including any documentation requirements, if we can, we will issue the Code Compliance Certificate.

If your consent was issued on or after 1 September 2021, you can log into Objective Build and request an extension of time.

1. Log in to our online building portal

2. Complete the application

Once logged into your dashboard, complete the Extension of Time application by selecting the Supporting Applications option and locating the relevant building consent.

If you are not ready to submit, you can save your application and complete it at a later stage.

3. Assessment

We will assess your application and will let you know our decision.

If your consent was issued before 1 September 2021, we generally get in contact with applicants at the 24-month stage with instructions as to how they can extend the time if required.

We will remind you as these deadlines approach and advise the steps that you can take, like extending the timeframes.

If we are not reasonably satisfied of compliance to the consent issued, we cannot issue the Code Compliance Certificate. We will issue a letter to the owner advising of this and detail the reasons why.

This decision does not prevent you from applying for a Code Compliance Certificate at a later date once the items listed on the refusal have been addressed.
