Notification of Summary of Decisions Requested
Whangarei District Council gave notice that it had prepared a summary of decisions requested by persons making submissions on proposed Plan Changes 4A and 4C – Temporary Activities and Minor Improvements.
Certain persons could make a further submission in support or opposition of any matter raised in the original submissions.
Changes to zoning were outside the scope of Plan Changes 4A and 4C. The scope of changes was limited to the matters set out below.
Plan Change 4A – Temporary Activities
- New chapter for Temporary Activities;
- Discrete amendments to other chapters specific to temporary activities as detailed in section 4.5 of the Section 32 Report for Plan Change 4A.
Plan Change 4C – Minor Improvements
- The issues identified, and the provisions that are proposed to be amended or inserted by Plan Change 4C, as detailed in section 4 of the Section 32 Report for Plan Change 4C;
- The proposed amendments to the Road Hierarchy layer of the Energy, Infrastructure and Transport mapping group within the District-Wide Matters maps.
Further submissions closed

Plan Changes 4A and 4C: Temporary Activities and Minor Improvements
They were also available for printing upon request at all Whangarei District Council service centres:
- Te Iwitahi (civic centre), 9 Rust Avenue, Whangārei
- Ruakākā Service Centre, Takutai Place, Ruakākā
- Whangārei Central Library, Rust Avenue, Whangārei.

Further submissions
No later than 10 working days after the date on which this public notice was given, any of the following persons could make a further submission on the plan change:
- Any person representing a relevant aspect of the public interest; and
- Any person who has an interest in the proposed plan change greater than the interest that the general public has; and
- Whangarei District Council.
A further submission given had to be limited to a matter in support of or in opposition to the relevant submission made under Clause 6 or 6A to Schedule 1 to the Resource Management Act 1991.
The person who made a further submission must within five (5) working days of making the further submission to Council, serve a copy of the further submission on the submitter to which the further submission relates.
The further submission must be made in the form prescribed in Form 6 of Schedule 1 to the Resource Management (Forms, Fees, and Procedure) Regulations 2003.
Public participation process
The process for public participation in the consideration of the proposed Plan Changes is:
- After the closing date for submissions, Whangarei District Council must prepare a summary of the decisions requested by submitters and notify the availability of this summary for inspection.
- A further submission period must follow, where certain persons may support or oppose matters raised in the submissions already made.
- Where persons making a submission ask to be heard in support of their submission, a hearing must be held.
- Whangarei District Council must give and notify its decision on the provisions of the proposed Plan Changes and matters raised in the submissions (including its reasons for accepting or rejecting submissions).
- Any person who has made a submission has the right to appeal the decision to the Environment Court.
