Plan Changes 4A and 4C: Temporary Activities and Minor Improvements

Whangarei District Council gives notice pursuant to Clause 5 of the First Schedule of the Resource Management Act 1991 that it has prepared the following plan changes to the Whangārei District Plan:  

  • Plan Change 4A - Temporary Activities (PC4A)
  • Plan Change 4C - Minor Improvements (PC4C)

Changes to zoning are outside the scope of Plan Change 4A and 4C. The scope of changes is limited as set out below.

PC4A

  • New chapter for Temporary Activities; 
  • Discrete amendments to other chapters specific to temporary activities as detailed in section 4.5 of the Section 32 Report for PC4A.  

PC4C

  • The issues identified, and the provisions that are proposed to be amended or inserted by PC4C, as detailed in section 4 of the Section 32 Report for PC4C; 
  • The proposed amendments to the Road Hierarchy layer of the Energy, Infrastructure and Transport mapping group within the District-Wide Matters maps.

Legal effect of proposal

Whangarei District Council has resolved that the rules in Plan Changes 4A and 4C shall take legal effect as follows:

  • Pursuant to Section 86B(1)(c) of the Resource Management Act 1991, Whangarei District Council has resolved that the rules in Plan Changes 4A and 4C shall have legal effect only once the proposed plan changes become operative in accordance with Clause 20 of Schedule 1 to the Resource Management Act 199; except that: 
  • In accordance with section 86B(1)(a) of the RMA, the proposed amendments to the Road Hierarchy layer of the Energy, Infrastructure and Transport mapping group within the District-Wide Matters maps will have legal effect once a decision on submissions relating to this mapping layer is made and publicly notified.

The proposal Plan Changes may be inspected from 1 April 2026 onwards on this website and were also available for printing upon request at all Whangarei District Council Service Centres:

  • Te Iwitahi (civic centre), 9 Rust Avenue, Whangārei
  • Ruakākā Service Centre, Takutai Place, Ruakākā
  • Whangārei Central Library, Rust Avenue, Whangārei.

Submissions

Any person may make a submission on the proposed Plan Changes. Submissions can be made in writing or electronically.

Submissions must be in Form 5, or a similar format that complies with Resource Management (Forms Fees and Procedure) Regulations 2003.

Form 5 is available on this website, at the locations listed above (under Public Inspection) upon request, or by contacting our District Plan Department at the address for service on this public notice.

Plan Changes 4A and 4C: Temporary Activities and Minor Improvements

Public participation process

The process for public participation in the consideration of the proposed Plan Changes is:

  • After the closing date for submissions, Whangarei District Council must prepare a summary of the decisions requested by submitters and notify the availability of this summary for inspection.
  • A further submission period must follow, where certain persons may support or oppose matters raised in the submissions already made.
  • Where persons making a submission ask to be heard in support of their submission, a hearing must be held
  • Whangarei District Council must give and notify its decision on the provisions of the proposed Plan Changes and matters raised in the submissions (including its reasons for accepting or rejecting submissions)
  • Any person who has made a submission has the right to appeal the decision to the Environment Court.
