Plan Change 5: 422 Marsden Point Road Rezoning (Private Plan Change)

Overview

A private plan change has been proposed to rezone 422 Marsden Point Road (Lot 1 DP 527727) from Heavy Industrial Zone to Light Industrial Zone and introduce a precinct overlay.

A precinct is a planning tool that adds extra rules to a specific site, on top of the standard zoning rules. In this case, the precinct would allow more permissive rules for a limited range of commercial activities, such as Trade Retail, Food and Beverage, Drive-Through Facilities, and General Retail, than what is typically allowed in the Light Industrial Zone. 

The applicant’s intent of the rezoning is to make it more attractive for development and enable the operation of appropriate specified commercial activities, while ensuring that potential effects on nearby properties and businesses are carefully managed.

Background to private plan change

On 20 December 2024, we received a request for a private plan change.

Following the initial review, we requested further information from the applicant to support the application. This additional step was necessary to ensure the proposal was complete and met statutory requirements.

On 17 July 2025, after receiving and assessing the requested information, we decided to accept the request.

Accepting a private plan change request means that the Council agrees to process the request and proceed with public notification, submissions and hearings.

It does not imply that the Council supports or endorses the proposed plan change; rather, it initiates a formal process to evaluate the request based on community input and thorough assessment.

Since the decision to accept the request, On Point Northland has transferred the Application to Wilshire Holdings Ltd.

What changes are being proposed?

The proposed changes include:

  • Rezoning 2.4 hectares of land at 422 Marsden Point Road from Heavy Industrial Zone to Light Industrial Zone.
  • Precinct provisions to enable the following:
    • Trade Retail - Permitted where the Gross Floor Area exceeds 250m².
    • Food and Beverage Activities - Permitted as per the underlying Light Industrial Zone rules, or where the activity is located within the same building as a trade retail or industrial activity, and the Gross Floor Area is less than 450m².
    • Drive-Through Facilities - Permitted where the Gross Floor Area is less than 450m².
    • General Retail (as primary use) - Restricted Discretionary Activity where the Gross Floor Area is greater than 250m2.

What does this mean for my property?

This change won’t affect the rules that apply to your property, but if approved it would enable different activities at 422 Marsden Point Road to those activities currently enabled by the District Plan.

The proposed rules won’t have legal effect until decisions on any submissions received are made.

Who can make a submission?

The plan change was notified to parties identified as potentially directly affected.

All owners and occupiers of properties within 500 metres of 422 Marsden Point Road, as well as properties zoned Business Zone in the Ruakākā / Marsden area, have been formally notified and given the opportunity to make a submission.

Only directly affected parties can make a submission from Wednesday 26 November 2025 to 4:00pm on Wednesday 28 January 2026.

Requests for further information

The Applicant submitted the plan change request application on 20 December 2024.

We reviewed the application and determined further information was necessary to assess the request. The request for further information was sent to the Applicant on 7 February 2025.

The Applicant responded on 17 March 2025, but key issues remained.

A second request was issued on 4 April 2025, and a response was received on 9 May 2025. However, the information still did not fully address the outstanding matters.

Modification of Request

On 23 May 2025, Council issued a notice proposing modifications to the precinct provisions. The applicant accepted all proposed changes on 27 May 2025.
